2. Eligibility

The Promotion is open to natural persons who are eighteen (18) years of age or older at the time of entry, who are employees of a NetApp Partner Reseller and who post during the specified Entry Period (see Section 3 Entry Period). Void where prohibited by law.

The Promotion is not open to employees, directors, officers, representatives or agents of the Sponsor and its related affiliates and subsidiaries. Government officials or employees of state-owned entities are not eligible to enter or win. All eligibility requirements must be met in order to claim a Prize (see Section 5 Determination and Notification of Winner and Section 6 Prizes).

3. Entry period

Entries must be submitted and fully complete between February 24, 2020 and April 17, 2020 by 5pm PT to be eligible for the Giveaway.

4. How to enter

To be entered into the Promotion, Entrants must post at least one photo of themselves wearing NetApp Partner Gear with the @NetAppPartner handle and #NetAppMVP hashtag to enter. Only Social Media posts on Twitter will be eligible. Once the Entrant has posted, they will be automatically eligible to win a prize. This must be done during the Entry Period described above for the entrant to be eligible for a prize.

5. How to enter

Any Entrant who fully completes the requirements in Section 4 will be eligible for a prize at the conclusion of the Entry Period. One (1) Winner will be chosen via a randomized drawing. Winner will be notified via the social media account used for the post and will be given instructions on how to claim their prize.

6. Prizes

Sponsor will award the Winner one of the following: one (1) Apple Series 5 Watch with an approximate retail value of $499 USD.

7. Terms and conditions

The Promotion is governed by these Official Rules. By participating in the Promotion, entrants fully and unconditionally agree to be bound by the terms and conditions of these Official Rules and understand that the Promotion results are final in all respects. Entrants agree that all decisions regarding the Promotion, including but not limited to the selection of the Winners, will be made by Sponsor, whose decisions shall be final and binding.

No purchase or payment necessary to enter or win. Limit one (1) entries and one (1) Prize per person. Entries must be received during the Entry Period. Entries received after the Entry Period will be declared invalid. Your entry is confirmation that acceptance of the Prizes does not violate your employer’s rules regarding the acceptance of gifts.

You may not enter more times than indicated by using multiple email addresses, identities or devices in an attempt to circumvent the rules. If, in the Sponsor’s opinion, there is any suspected tampering or evidence of actual tampering or technological corruption, Sponsor reserves the right to void any suspect entries. Any attempt by an entrant to undermine the legitimate operation of the Promotion is a violation of criminal and civil laws and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person and to seek other remedies to the fullest extent permitted by law. Sponsor is not responsible for late, lost, delayed, damaged, misdirected, incomplete, void, and/or corrupted entries, or for any problems, bugs or malfunctions entrants may encounter when submitting their entry.

Prizes are limited while supplies last. Odds of winning a Prize depend on the number of eligible entries received. Sponsor will not replace any lost or stolen Prize; the Prize is offered and must be accepted “as is” without warranty of any kind. The approximate retail values are subject to change based on current market conditions at the time of prize fulfillment. Winners are not entitled to any surplus between actual retail value (ARV) of the Prize and approximate retail value as stated in Section 6 and any surplus will not be awarded. No substitution, assignment, transfer, or cash redemption of any Prize is allowed by the Winners. Sponsor reserves the right to substitute a Prize with another Prize of equal or greater value should the advertised Prize become unavailable for any reason. Any costs or expenses associated with claiming or redeeming any Prize will be the sole responsibility of Winner(s). The Winners are solely responsible for all applicable national, federal, state, provincial and local taxes. All national, federal, state, provincial and local laws apply.

Failure to claim a Prize will result in forfeiture of the Prize and an alternate Winner may be selected. Winners may be requested to provide Sponsor with proof that he/she is the authorized account holder of the email address associated with the winning entry and that all eligibility requirements are met. All personal and other information requested by and supplied to the Sponsor for the purpose of the Promotion must be truthful, complete, accurate and in no way misleading. Sponsor reserves the right, in Sponsor’s sole discretion, to disqualify any entrant should such an entrant supply untruthful, incomplete, inaccurate or misleading personal details and/or information. If a potential Winner is unable to participate in or accept the Prize or any portion of the Prize for any reason, Sponsor shall have no further obligation to such potential Winner.

Entrants agree that Sponsor is not responsible for [i] lost, late, delayed, misdirected, stolen, unintelligible, or incomplete submissions; [ii] telephone, electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties; [iii] errors in transmission; or [iv] any condition caused by events beyond Sponsor’s control that may affect the Promotion. All entries become the property of Sponsor.

By entering the Promotion, each entrant agrees to release and hold Sponsor harmless from any and all losses, damages, rights, claims, and actions of any kind in connection with the Promotion or resulting from acceptance, possession, or use of any Prize, including, without limitation, personal injuries, death, and property damage, and claims based on publicity rights, defamation, misappropriation of likeness, or invasion of privacy. Entrants agree that the Sponsor shall have no liability whatsoever for any deficiency or malfunctioning of any Prize, for any damage incurred from use or participation of the Prize, or from participation in the Promotion.

Sponsor reserves the right to change, alter, or amend these Official Rules or terminate the Promotion, in its sole discretion, to provide fair administration of the Promotion or to comply with applicable law. These Official Rules are governed by the laws of the State of California without regard to conflict of laws principles. By participating in the Sweepstakes, entrants hereby agree that the exclusive jurisdiction and venue for any claims, actions, or proceedings relating to the Sweepstakes shall be the state and federal courts located in Santa Clara County, California. If any provision of these Official Rules is found by a court of competent jurisdiction to be invalid or unenforceable, such invalidity or unenforceability will not invalidate or render unenforceable, any other part of these Official Rules.

8. Data protection

All information, including personal data, collected in submission of entries during the Promotion, will be maintained and protected by Sponsor in accordance with applicable data protection laws. The personal data you provide will be used strictly for the purpose of managing the Official Rules of this Promotion, and to provide you with information related to NetApp products, services and events. You may opt out of receiving information from NetApp at any time by writing to privacy@netapp.com.
