Network Appliance Announces Dismissal of Derivative Lawsuit

Sunnyvale, Calif. - June 26, 2007 -- Network Appliance, Inc. (NASDAQ: NTAP) today announced that a shareholder derivative lawsuit filed against the Company and various officers and directors at Network Appliance has been dismissed. During fiscal year 2007, two shareholder derivative lawsuits were filed and alleged improper practices relating to the timing of stock option grants. The two cases were combined into a single consolidated action. On June 22, 2007, the parties to the action stipulated to voluntarily dismiss the consolidated action. On June 25, 2007, the Court entered an Order dismissing the consolidated action without prejudice.

As stated in a NetApp press release dated October 26, 2006, the Company conducted a thorough review of its options granting process and found no evidence of any backdating of stock option grants. The review was conducted over a year ago, prior to the recent wave of investigations of other public companies related to options issuance practices, and was a contributing factor in the dismissal of the shareholder derivative lawsuit.
